Is The Can Spam Legislation Useless?

It is a daily issue, every time we turn on our computers and check our email we must begin the process of weeding through the junk mail to find the legitimate email you've been waiting for from friends, family or work colleagues. It seems like there is more and more spam every single everyday! With the large volume of unsolicited email that we receive in our email inboxes on a daily basis, it was just a matter of time before the Government got involved and brought about some legislation. That is where the CAN SPAM Act comes in.

The CAN SPAM Act stands for Controlling the Assault of Non-Solicited Pornography And Marketing. The CAN SPAM Act 2003 was passed by the senate on November 25, 2003. The House of Commons agreed to the bill on December 8, 2003 and the President of the United States signed it on December 16, 2003. The bill took effect on January 1, 2004.

The CAN SPAM Act was implemented in response to the large numbers of unsolicited email or Spam that people are receiving and the general dissatisfaction with the situation. The Act is supposed to control the amount of unsolicited pornography and mass marketing that enters into the public’s inboxes.

Despite the regulations that the CAN SPAM Act 2003 attempts to implement, you will likely still receive Spam. There are few ways with the CAN SPAM Act to report spam. There are spam bureaus where you can register the offender or you can contact the US Federal Trade Commission to report the offensive spam.

There is a debate surrounding the effectiveness of the CAN SPAM ACT. Many people believe that there has been little to no impact on the amount of spam that enters their inbox. Some people that you talk to will even insist that they now receive more unsolicited email than ever before. Unfortunately the Can Spam Act only regulates the sending of bulk unsolicited email within the United States whereas the vast majority of junk email comes from mail servers located in the former Soviet Union and China.

While the CAN SPAM Act may not be the most effective weapon against the war against spam, it is a step in the right direction. Regardless of what anti-spam laws are passed now or in the future using spam filtering software and services is going to be part of everyday computer life for the forseeable future.
